These Terms of Service ("Terms") govern your use of crucesnewhomes.com and the services provided by Cruces New Homes ("we", "us"). By using this website or providing your phone number through any form on this site, you agree to these Terms and our Privacy Policy.
What we do
Cruces New Homes is a free buyer-side real estate concierge serving home buyers in the Las Cruces, New Mexico metro area. We connect prospective buyers with our New Home Expert, who helps them tour and compare new construction homes from the major Las Cruces builders. There is no fee to the buyer for our concierge service.
SMS / text message terms
Opt-in. When you submit your phone number through any form on crucesnewhomes.com, you expressly consent to receive recurring automated promotional and informational text messages and phone calls (including from automated systems and AI assistants) from Cruces New Homes at the phone number provided. Consent is not a condition of any purchase. By providing your phone number you also agree to our Privacy Policy.
Message frequency. You can expect approximately up to ten (10) messages per month, depending on your engagement with our service. This may include initial follow-up texts, appointment reminders, and weekly Las Cruces new-home updates.
Message and data rates. Message and data rates may apply. Cruces New Homes is not responsible for fees charged by your wireless carrier for text messages or phone calls. Contact your carrier for details.
How to stop messages. You can opt out of SMS at any time by replying STOP to any of our text messages. After you reply STOP, we will send one final message confirming your opt-out. You will not receive further messages from us at that number unless you re-subscribe by replying START.

Carriers. Supported wireless carriers include AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, MetroPCS, Cricket, Virgin Mobile, and others. T-Mobile is not liable for delayed or undelivered messages. Wireless carriers are not liable for delayed or undelivered messages.
Your phone number is not sold or shared. Your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. We share data only with the service providers we use to operate our service (such as our CRM and SMS delivery vendor), as described in our Privacy Policy.
Eligibility and accuracy
You must be at least 18 years old to use this site or submit your contact information. You agree that the information you provide through any form on this site is accurate and that the phone number you provide is your own or that you have the account holder's permission to provide it.
No agency relationship until contracted
Submitting a form, speaking with our AI assistant, or speaking with our New Home Expert does not create a buyer's agency or fiduciary relationship. A buyer's agency relationship is only formed when you and our New Home Expert sign a written buyer-broker agreement. Until that point, no obligations or commissions are owed to either party.
Builder relationships and compensation
Cruces New Homes is compensated by the home builder, not by the buyer, when a transaction closes. We work with multiple Las Cruces builders. We do not represent any single builder exclusively, and we do not receive referral fees or kickbacks for steering buyers to a specific builder. Our concierge service is free to the buyer.

Service availability
We may modify, suspend, or discontinue any part of this service at any time. We do not guarantee uninterrupted access to the website or to our AI assistant.
Limitation of liability
To the maximum extent permitted by law, Cruces New Homes is not liable for any indirect, incidental, special, or consequential damages arising out of your use of this website, our AI assistant, or our concierge service.
Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of this site after we publish updated Terms means you accept the revised Terms.
Governing law
These Terms are governed by the laws of the State of New Mexico, without regard to its conflict of laws principles. Any dispute arising out of these Terms or your use of this site will be resolved in the state or federal courts located in Doña Ana County, New Mexico.
